La defensa de Carlos Zannini, el ex exsecretario de Legal y Técnica del kirchnerismo y hoy Procurador del Tesoro, reclamó que se anule el procesamiento que le dictó el fallecido juez Claudio Bonadio y también los pedidos de elevación a juicio que se hicieron en su contra, revelaron a Infobae fuentes judiciales. Si la jugada tiene éxito, inevitablemente beneficiará al resto de los acusados, entre los que está la vicepresidenta Cristina Kirchner, quien desde diciembre ya no tiene prisión preventiva en el expediente.

La defensa, a cargo del abogado Mariano Fragueiro Frías, sostuvo que para que una causa sea elevada a juicio es necesario que esté completa la instrucción, con el fin de garantizar el derecho de defensa porque es imposible defenderse de algo que no se conoce. Sin embargo, remarcó, en esta se dejó un tramo de la investigación en instrucción: precisamente la que apunta al rol de Interpol. Es la figura del ex titular de Interpol, Ronald Noble, la que -a criterio de la defensa- podría esclarecer la situación de los acusados porque, tal como lo dijo públicamente el ex funcionario, se demostraría que las alertas rojas no estuvieron en peligro con la firma del Memorándum.

“En este proceso se concreta ahora aquello que palpitó siempre en la mente de los perseguidores, nos referimos al eco inconstrastable de que las oficinas de INTERPOL fueron parte de esa desopilante hipótesis criminal, y sin su invalorable auxilio normativo y funcional nada de esto, aún en esta extraña calificación de encubrimiento sui generis, hubiera ocurrido. Aclaro esta es la hipótesis que sostiene la acusación como corolario de su infatigable deseo de que el Secretario General de INTERPOL no declare como testigo en esta causa”, se sostiene en el escrito al que accedió Infobae y que ahora deberá analizar los jueces del TOF Gabriela López Iñiguez, José Michelini y Daniel Obligado.

Todo se aceleró por la causa que está en instrucción. Allí Zannini pidió frenar un pedido de informes sobre Noble, en donde se lo investiga como presunto imputado. El juez Marcelo Martínez De Giorgi rechazó ese planteo teniendo en cuenta que Zannini ya no era ya parte de la instrucción. Ahora, la defensa apeló ante la Cámara Federal, que responderá en los próximos días.

Frente a eso, Zannini se presentó ante el TOF 8 esta mañana. Aseguró que recién ahora comenzaron a investigar a Noble, luego de dos años de que el caso se envió a juicio oral “Esto es inaceptable, porque no es lo mismo defenderse de un hecho en el que el encubrimiento fue en connivencia con miembros de INTERPOL que sin ello”, dijeron desde la defensa. Además, resaltaron que los funcionarios de INTERPOL tienen inmunindad de jurisdicción, lo que significa que no pueden ser investigados por un juez de Instrucción argentino. Solo debería hacerlo la Corte Suprema.

En diciembre pasado, un día antes de la jura de Alberto Fernández como presidente, Zannini había hecho otra jugada estratégica ante el TOF 8: reclamó que se le tome declaración como testigo vía teleconferencia y de manera inmediata a Ronald Noble, el ex titular de Interpol que cruzó a Nisman apenas el entonces titular de la UFI AMI hizo la denuncia por el Memorándum con Irán contra la ex presidenta. También solicitó la declaración anticipada de Joel Sollier, consejero jurídico en 2013 que manifestó cuando se firmó el Memorándum que el acuerdo no implicaba “ningún tipo de cambio en el estatus de las certificaciones rojas aplicadas en relación a los crímenes investigados en la causa AMIA».

No es un dato menor. Se trata de la prueba que reclamó la defensa del ex canciller Héctor Timerman, desde que estalló el caso hasta que murió. Es que Noble es una carta esencial para las defensas: dirá que ningún funcionario kirchnerista intentó levantar las alertas rojas que pesan sobre los iraníes sospechados de haber participado del ataque a la mutual judía. Para los acusados, el testimonio de Noble demostrará que nunca se buscó dar impunidad a los acusados de volar la mutual judía, clave de la acusación.

Hasta ahora Noble nunca declaró en el expediente. Él mismo se encargó de pedirlo públicamente. Primero hubo un debate sobre si tenía inmunidad como funcionario de Interpol. Después, la querella de la DAIA planteó que debía ser imputado. A criterio de Zannini, el hecho de no haber llamado a Noble como testigo “demuestra el tinte político y utilitario que se le ha impreso a este irregular proceso”.

La causa nació con la denuncia que hizo Nisman cuatro días antes de aparecer con un tiro en la cabeza en el baño de su departamento. Fue en enero de 2015. En aquel momento, la denuncia de Nisman fue desestimada por el juez Daniel Rafecas, con el aval de la Cámara Federal. En 2016, se hizo una denuncia contra Cristina Kirchner y los legisladores que votaron el Memorándum. La Sala IV de la Cámara Federal de Casación avaló la reapertura de la denuncia de Nisman. Tras un breve paso por las manos del juez Ariel Lijo, la denuncia se concentró en el juzgado de Claudio Bonadio.

Hace exactamente dos años, el juez Bonadio procesaba y ordenaba la detención de Cristina Kirchner, el ex canciller Héctor Timerman, el ex secretario Legal y Técnico Carlos Zannini, el piquetero Luis D’Elía, el ex jefe de Quebracho Fernando Esteche y el lobista iraní Jorge Khalil. Sin prisión preventiva, fueron procesados el ex secretario general de la Presidencia Oscar Parrilli, la ex procuradora del Tesoro Angelina Abbona, el ex funcionario del Ministerio de Justicia Juan Mena, el diputado nacional Andrés Larroque, el ex vicecanciller Eduardo Zuain y el agente de inteligencia Alan Bogado.

A todas las acusaba de encubrimiento y traición a la Patria. Cristina Kirchner no fue presa porque en octubre se había convertido en senadora y tenía fueros. Precisamente, sobre eso habló la ex presidente en su indagatoria en el juicio oral en la causa de Vialidad. En tanto, a Timerman se le concedió la prisión domiciliaria por razones de salud.

La Cámara Federal confirmó los procesamientos (sin la figura de traición a la Patria) y las detenciones ese mismo diciembre de 2017. En enero, el entonces juez Torres le concedió la libertad a Timerman para que pudiera viajar al exterior a tratarse. El caso pasó rápidamente a un tribunal oral. El 24 de marzo de 2018, fueron liberados Zannini, D’Elía y Khalil por orden del TOF, que contaron con el aval de la fiscalía porque no había riesgos de fuga ni entorpecimiento. El único que quedó preso fue Esteche, ex líder de Quebracho, por una condena previa. Sin embargo, salió en libertad después de las PASO cuando estaba por cumplir dos años de preventiva.

La Corte Suprema confirmó en marzo de 2019 la prisión preventiva de la ex presidenta, al rechazar un recurso extraordinario porque no se trataba de una sentencia definitiva). La defensa de Cristina Kirchner nunca apeló esa prisión preventiva. Pero en diciembre pasado el TOF hizo caer esa orden de detención, nunca ejecutada porque CFK tenía fueros como senadora. Según el TOF, no existen elementos para hacer pensar en entorpecimiento de la investigación o una fuga por parte de Cristina Kirchner. Pero además, dijeron los magistrados, aquí se da «la circunstancia extraordinaria de que la aquí imputada ha sido recientemente investida como Vicepresidenta de la Nación”.
