En medio de debates sobre la grieta se insinúa la necesidad de muchos otros para avanzar en la búsqueda de justicia, por ejemplo en la Causa Amia.
Uno de ellos se refiere al juicio en Ausencia. Para algunos el camino más corto y posible hacia la verdad, sin condenas anticipadas ni islamofobia, para otros el cierre definitivo en el altar de la impunidad.

Hoy transmutadas en escaramuzas de los “trolls”, con el escenario de las redes sociales, redes donde casi siempre se escapa la verdad.
Luego de la batalla de Caseros, y la huída del Juan Manuel de Rosas a Inglaterra, los unitarios clamaban venganza y justicia, si es que ambas cosas pueden ir juntas.
Lo cierto es que en su legislatura sancionan una ley donde la palabra queda en manos de los perseguidos y proscriptos de antaño.
La ley se sanciona, se determinan los delitos y avanza el proceso. Con arrepentidos y todo que habían colaborado con el principal imputado.
Rosas es juzgado en ausencia. Sí en ausencia.
Un antecedente que seguramente nutre el incipiente debate como rareza y testimonio de que no todo resulta tan nuevo bajo el sol.
A los fines de estas líneas rescatamos el antecedente y utilización del procedimiento sin adentrarnos en consideraciones históricas y políticas ajenas a nuestro propósito.
La resolución donde le notifican la sentencia de primera instancia reza así:
Certifico en cuanto puedo y ha lugar por derecho, que en los diarios y parajes de costumbre se han publicado los edictos correspondientes para la notificación del prófugo siendo éstos con inserción de la anterior sentencia.
Y para que así conste, en cumplimiento de lo mandado pongo el presente que signo y firmo en Buenos Aires, a veinte y cinco de Abril de mil ochocientos sesenta y uno.

Era el resarcimiento para las víctimas mediante los bienes de Rosas. Rescatamos la expresión de Carlos Tejedor que se oponía a la confiscación de los bienes porque «la sociedad era solidaria de los crímenes de Rosas y todos los ciudadanos, sus cómplices».
Suena actual ante las coyunturas despiadadas donde la vida resultó agraviada en el país y en las tragedias que asolaron el mundo. La complicidad.
Cuando Juan Bautista Alberdi regresó a Buenos Aires, de sus voluntarios exilios, ya mayor, antes de retornar definitivamente a Europa, cumplió con el pedido de dirigirse a los alumnos graduados en derecho en la Universidad de Buenos Aires. La solicitud se la hizo el doctor Sixto Villegas.
Había sido el juez que condenó a Rosas en primera Instancia.
