El juez Canicoba Corral, cercano al Gobierno, requirió detalles sobre sus cuentas bancarias a las unidades anti-lavado de ambos países a través de la Unidad de Información Financiera local.
Rodolfo Canicoba Corral prepara exhortos para enviar a Uruguay y los EEUU con un pedido de información sobre cuentas bancarias vinculadas al fallecido fiscal Alberto Nisman, su familia y al empleado informático Diego Lagomarsino. Pero para al menos adelantar un paso decidió firmar una reciente medida de prueba pedida por la fiscalía.
Para saber detalles de posibles cuentas bancarias y bienes, el magistrado solicitó que la Unidad de Información Financiera (UIF) a cargo de José Sbatella requiera esos datos a sus pares de EEUU y Uruguay, con quienes tiene suscripto un pacto de cooperación internacional.
Se trata de una medida de prueba que había sugerido el fiscal Juan Pedro Zoni y que firmó recientemente el juez como parte de la causa que investiga las presuntas cuentas bancarias que Nisman, su familia y Lagomarsino tendrían en el exterior.
La idea es buscar vías más rápidas a lo que puede tardar el trámite de un exhorto judicial. Para eso, se solicitó a la UIF argentina que pida a la unidad anti-lavado de los EEUU datos sobre una cuenta bancaria de la que serían titulares Nisman; su mamá Sara Garfunkel, su hermana, Sandra, y el empleado Lagomarsino. En Uruguay también se sospecha de la existencia de otra cuenta, así como de propiedades.
Paralelamente, el juez trabaja en la elaboración de exhortos a Uruguay y Estados Unidos y los librará en los próximos días. Según la denuncia hecha por Sbatella, ni bien falleció Nisman trascendió la existencia de una cuenta bancaria en el Banco Merrill Lynch de Nueva York en la cual el fiscal figuraba como apoderado y Lagomarsino como titular de la misma al igual que la madre y hermana de Nisman, y ello para evitar controles tributarios.
También se intenta determinar de dónde salieron fondos que habrían sido depositados en esa cuenta y cuyo origen se desconocen. Fuentes judiciales habituadas a realizar este tipo de trámites con destino a los EEUU son escépticas sobre la posibilidad de que se le vaya a dar respuesta al pedido de información. Mucho menos de que se trate de algo inmediato.
En ese sentido, el pasado viernes la UIF amplió su denuncia ante el juez Canicoba Corral con el aporte de un artículo de Página 12 en el cual el ex director de la DAIA Jorge Elbaum aseguró que Nisman se ofreció a prestar fondos a la entidad para intentar evitar la aprobación del Memorándum de Entendimiento con Irán por la causa AMIA. «Si es necesario, Paul Singer nos va a ayudar», habría dicho el fiscal.
Ahora la UIF pidió al magistrado que lo cite como testigo. Aunque previamente pedirá opinión al fiscal Zoni sobre qué medidas de prueba se deben realizar tras esa presentación.
Por otra parte, y a los fines de los exhortos que prepara el juzgado, el fiscal Zoni precisó que el delito por el cual se investiga a Lagomarsino y al entorno de Nisman es de lavado de dinero.
«Así las cosas, este Ministerio Público entiende que por el momento los hechos investigados encuadran en la figura delictiva establecida en el artículo 303 del Código Penal, que dispone que será reprimido con prisión de tres a diez años y multa de dos a diez veces del monto de la operación, el que convirtiere, transfiriere, administrare, vendiere, gravare, disimulare o de cualquier otro modo pusiere en circulación en el mercado, bienes provenientes de un ilícito penal, con la consecuencia posible de que el origen de los bienes originarios o los subrogantes adquieran la apariencia de un origen lícito», precisó Zoni en un requerimiento.
Por lo pronto, la investigación apunta a la colaboración internacional. También se está revisando documentación que aportó la fiscal Viviana Fein, quien investiga la muerte de Nisman, vinculada con la cuenta que genera sospechas sobre la relación entre Lagomarsino y el fiscal. Los investigadores aseguran que de llegar a develarse los detalles en torno a la cuenta y los fondos que recibía la muerte del ex titular de la Unidad AMIA sería resuelta.
