Tras nueve audiencias, y en la última audiencia del 2017, la fiscalía del juicio por encubrimiento de la investigación del Atentado a la AMIA concluyó su alegato y le pidió, al Tribunal Oral Federal Nº 2 (TOF 2), penas a doce de los trece imputados. El único que quedó absuelto es al ex comisario de la Policía Federal, Jorge «Fino» Palacios.
El único imputado que tendría la pena más alta, según el alegato final de la fiscalía, sería el ex juez Juán José Galeano por quien se pidió trece años de prisión e inhabilitación perpetua por los delitos de encubrimiento, abuso de autoridad e incumplimiento de los deberes de funcionario público, prevaricato, violación de medios de prueba, partícipe necesario del delito de peculado y autor de la privación ilegítima de la libertad de los policías bonaerenses. Por su parte, al ex presidente Carlos Menem consideraron que debían condenarlo a cuatro años de cárcel e inhabilitación por ocho años por el delito de encubrimiento, abuso de autoridad, violación de medios de prueba e incumplimiento de los deberes de funcionario público.
A continuación las penas de los trece imputados:
Juan José Galeano: trece años de prisión e inhabilitación perpetua por los delitos de encubrimiento, abuso de autoridad e incumplimiento de los deberes de funcionario público, prevaricato, violación de medios de prueba, partícipe necesario del delito de peculado y autor de la privación ilegítima de la libertad de los policías bonaerenses.
Ex fiscales Eamon Mullen y José Barbaccia: ocho años de prisión e inhabilitación perpetua por privación ilegal de la libertad de los ex policías, coacción agravada y por el delito de peculado, todo en calidad de partícipes necesarios.
Carlos Menem: cuatro años de prisión e inhabilitación por ocho años. Esto por el delito de encubrimiento, abuso de autoridad, violación de medios de prueba e incumplimiento de los deberes de funcionario público.
Hugo Anzorreguy, ex jefe de la SIDE: Seis años por los delitos de peculado y encubrimiento en calidad de partícipe necesario, falsedad ideológica, abuso de autoridad e incumplimiento de los deberes de funcionario público.
Juan Carlos Anchezar, subsecretario de la SIDE: Tres años de prisión e inhabilitación por seis años por participar del encubrimiento, ser coautor del delito de falsedad ideológica, abuso de autoridad e incumplimiento de los deberes de funcionario público.
Carlos Castañeda, ex jefe del Departamento de Protección al Orden Constitucional: Tres años de prisión e inhabilitación por seis debido al delito de falsedad ideológica, encubrimiento como participe necesario, violación de medios de prueba, abuso de autoridad y violación de deberes de funcionario público.
Patricio Finnen, ex agente de la SIDE, quien participó del pago ilegal a Telleldín: Dos años de prisión por participar justamente del delito de peculado.
Ana Boragni, ex pareja de Telleldín, quien cobró el dinero de la SIDE: Dos años de prisión como partícipe necesaria del peculado. En tanto por el mismo delito, a Carlos Telleldín y a Víctor Stinfale, su entonces abogado, le caben tres años y seis meses.
Rubén Beraja, ex presidente de la DAIA: Un año de prisión por ser partícipe secundario del peculado.
Jorge “Fino” Palacios, ex comisario de la Policía Federal: absolución de todos los delitos.
