La Comisión de Legislación Penal de la Cámara de Diputados dictaminó un proyecto que busca instrumentar el juicio en ausencia. Se trata de un instituto legal que se aplicaría en aquellas situaciones en las que un imputado no se presentare frente a la justicia, sea por rebeldía, por fuga o paradero desconocido, por no haber sido entregado al tribunal por las autoridades estatales competentes o por algún otro motivo.
Se analizaron cuatro proyectos de ley para su tratamiento, que fueron presentados por los diputados Daniel Lipovetzky (PRO), Pablo Tonelli (PRO), Luis Petri (UCR) y Jorge Enríquez (PRO). Durante la reunión se relacionó la iniciativa con la búsqueda de justicia en los atentados de la AMIA y la embajada de Israel.
El proyecto de ley busca reglamentar el juicio en ausencia para los casos de delitos graves contra la humanidad como el genocidio, los crímenes de guerra y los delitos de lesa humanidad y también para los casos de delitos perpetrados por el crimen organizado como el narcotráfico.
La titular de la Comisión, Gabriela Burgos, recordó que se citó a funcionarios públicos, especialistas y juristas, quienes dieron su postura a los legisladores acerca de los alcances de esta herramienta legal. “Tenemos que implementar herramientas para que esas causas que han sido resonantes y que nos duelen a los argentinos, no queden en la impunidad”, dijo Burgos.
En tanto, el diputado Lipovetzky consideró que “venimos trabajando en un texto que empiece a resolver situaciones de impunidad que se dan en el sistema penal argentino”. “Es importante destacar que la propia jurisprudencia de la Corte Suprema ha recogido la viabilidad de extradiciones de condenados en ausencia”, agregó Lipovetzky, antes de mencionar el caso de Alfredo Astiz y de Erich Priebke.
“Se cumplen 25 años del atentado a la AMIA y la causa está paralizada por la ilusión de los acusados de no presentarse. La mejor manera de homenajear a esas víctimas es dictaminar el juicio en ausencia, darle a la justicia una herramienta para terminar con la impunidad”, resumió Lipovetzky.
El diputado Petri, también autor de uno de los proyectos, consideró que se trata de “un día histórico”. “Desde 1994 las víctimas y sus familiares reciben impunidad e injusticia respecto al grave atentado que conmocionó a la sociedad argentina”, dijo.
“La Constitución no sólo no lo prohíbe, sino que pasa a ser un imperativo constitucional en virtud de los tratados internacionales. El juicio en ausencia ha sido utilizado por los países del mundo a la hora de juzgar situaciones en rebeldía”, mencionó Petri.
También autor de un proyecto sobre el tema, el diputado Enríquez subrayó que lo motivó “el recuerdo de las 85 víctimas y el propósito más amplio de incluir a los delitos que contemplan atentar contra el Estado de Derecho y la República”.
Por último, el diputado Tonelli celebró el dictamen de la iniciativa y la calificó como “un paso contra la impunidad y en favor de la justicia”. “El proyecto va a servir para que haya menos impunidad, para que las víctimas se sientan aliviadas en la medida que el Estado logre llegar a una medida punitiva sobre los culpables”, aseveró Tonelli.
Desde el Frente para la Victoria –PJ, Rodolfo Tailhade adelantó el rechazo de su bloque y criticó el tratamiento legislativo de la iniciativa: “Es preocupante la falta de debate parlamentario que caracteriza este proyecto”.
“En la única reunión que hubo no se invitó a los bloques a proponer expositores. Se está utilizando un hecho tan serio como el atentado a la AMIA para tergiversar lo que dice la normativa internacional”, añadió. Asimismo, Tailhade dijo que el principal problema de los proyectos “es la violación del derecho de defensa” y agregó que “la Corte Suprema ha rechazado extradiciones a partir de condenas en juicios por ausencia”.
Sobre el cierre de la reunión, también plantearon observaciones la diputada Paula Oliveto, de la Coalición Cívica, y el diputado Juan Fernando Brügge, de Córdoba Federal, quienes firmaron el dictamen en disidencia parcial.
