La Policía de Maldonado, Uruguay, investiga a un sujeto por sus comentarios antisemitas colgados en la página de Facebook del complejo Oh! de La Barra.
Gonzalo Peloche, abogado de la firma propietaria del complejo, explicó a El País que la denuncia fue radicada semanas atrás en dependencias policiales.
La investigación policial identificó al autor de los comentarios raciales, un sujeto que tiempo atrás trabajó como guardia de la empresa a cargo de la seguridad del complejo.
El acusado fue interrogado en dependencias policiales y ahora se espera la decisión del magistrado de turno para continuar con las actuaciones y su eventual conducción a sede judicial.
”El dueño es judío sino hay público que gaste dinero en los locales no le resulta la negocia, Ja” y luego ante un comentario de otra persona expresa “Jaja excusas que pone el señor y manda a sus monigotes a dar la cara menos mal que Fabio y yo nos retiramos antes de todos esos inconvenientes pero siempre consigue un payaso que de la cara por el señor. tas loco”, sostiene la denuncia presentada ante las autoridades policiales de Maldonado.
Peloche explicó que los comentarios del ahora denunciado exceden la libertad de expresión y que de forma presumible pueden constituir un delito.
“En este sentido la legislación penal uruguaya prevé sanciones para quienes ejecuten actos de desprecio o violencia hacia ciertos grupos de personas en razón entre otras cosas por razón de religión”, agregó.
A su juicio a la condición de judío de uno de los integrantes de la empresa propietaria del complejo “constituye una clara extralimitación de su derecho a expresarse y el mismo presenta apariencia delictiva, que deberá dilucidar la justicia penal”.
El Código Penal en su articulo 149 Ter bajo el acápite “Comisión de actos de odio, desprecio o violencia hacia determinadas personas” dispone que, “El que cometiera actos de violencia moral o física, de odio o de desprecio contra una o mas personas en razón de su color de piel raza, religión, origen nacional o étnico, orientación sexual o identidad sexual, será castigado con seis a veinticuatro meses de prisión”.
En el mismo sentido, recordó Peloche, el ordenamiento uruguayo estableció en Ley 17.817 que a sus efectos se entenderá por discriminación toda distinción, exclusión, restricción, preferencia o ejercicio de violencia física y moral, basada en motivos de raza, color de piel, religión, origen nacional o étnico, discapacidad, aspecto estético, género, orientación e identidad sexual, que tenga por objeto o por resultado anular o menoscabar el reconocimiento, goce o ejercicio, en condiciones de igualdad, de los derechos humanos y libertades fundamentales en las esferas política, económica, social, cultural o en cualquier otra esfera de la vida pública.
