A 1 AÑO DE LA MUERTE DEL FISCAL ALBERTO NISMAN- Facundo Pastor, periodista de investigación y autor del libro «Nisman- ¿Crimen o Suicidio? ¿Héroe o Villano? de la editorial Margen Izquierdo dialogó en exclusiva con la CADENA JUDÍA DE INFORMACIÓN VIS A VIS desmitificando algunos mitos que se generaron alrededor de la figura del fiscal de UFI-AMIA, como así también, dando su punto de vista sobre el papel de Antonio Jaime Stiuso en la muerte de Nisman.
– ¿Quién fue Alberto Nisman?
– Nisman era un fiscal federal temático por que su carrera giró alrededor de la investigación sobre el terrorismo y que se especializó en esa materia.
– ¿En qué sentido temático?
– Desde que llegó a la causa AMIA en 1997 él desarrolla una suerte de especialidad y su tésis de vida fue investigar el atentado a la AMIA. Por eso era tan consultado en la materia y para algunos un referente.
– Luego de su muerte se habló mucho de los vínculos que tuvo Nisman con los Servicios de Inteligencia del Mossad y de la CIA, y hasta fue acusado de ser un agente de inteligencia ¿Qué pudiste averiguar a partir de tu libro?
– Yo no puedo asegurar que Alberto Nisman fuera un agente de inteligencia. De hecho es algo que yo me lo planteo en el libro. Sí creo primero como fiscal especializado en terrorismo, y obviamente sí como instructor de la causa AMIA, es más que lógico que se base y se vincule con fuentes de inteligencia tanto nacionales como internacionales. Respecto al Mossad, yo describo en el libro un viaje que él realiza a Israel para establecer cierto acercamiento al servicio de inteligencia israelí, un viaje que en su momento fue organizado por una agencia de inteligencia en Argentina llamada SIA. Yo creo que Nisman por momentos superó o sobrepasó ese rol funcional de cercanía, de necesidad y de interacción con los agentes de inteligencia. Pero no puedo asegurar que haya tenido vinculo con la CIA, pero sí el ex fiscal de UFI-AMIA era un referente jurídico del FBI en la región. De hecho el dictamen del 2006 ratificado en 2011 fue algo que su momento, en el 2007, cuando en Estados Unidos descubre una red que iba a cometer un atentado en el aeropuerto John Fiztgerald Kennedy. En la propia investigación se utiliza la tesis Nisman de cómo había sido infiltrada la región con diferentes referentes de Hezbollah a través de las sedes diplomáticas en países como Argentina, Venezuela, Brasil, Uruguay, en las Guayanas francesas y Trinidad y Tobago. Esa es la tesis que la vuelca en el dictamen del 2006, y el FBI lo toma muy seriamente y lo convierte en una suerte de referente. ¿Eso podría llegar a hacernos concluir que Nisman era una un agente de inteligencia? No lo sé. Es muy difícil responder eso, pero tenía bastos vínculos con el FBI.
– Sara Garfunkel, madre de Nisman, está siendo investigada por lavado de dinero, y mucho se habló sobre el manejo que de dinero que tuvo el fiscal de UFI-AMIA dentro de la fiscalía…
– Creo que son dos cosas distintas. Una fue la utilización de los fondos públicos de la Fiscalía UFI-AMIA fue algo que a través de dos o tres contrataciones uno vislumbraba no se si una conducta que podía llegar a tener una imputación penal o no, pero sí, un manejo discrecional de la plata con la que fue fortalecida esa unidad de investigaciones, que era mucho dinero para una fiscalía. Creo que hay que fortalecerla aún más. Respecto de la investigación que se lleva adelante con la madre, Sara Garfunkel, hay una investigación que trata de esclarecer de dónde provienen los 700 mil dólares que había dentro de una cuenta que estaba a nombre de familiares y de Diego Lagomarsino con un poder amplio a disposición del propio Nisman.
Lógicamente ese fue un mecanismo que el fiscal llevó adelante para que en Estados Unidos, al ser una persona políticamente expuesta, no le pregunten de dónde venía el dinero. El dinero, al estar a nombre de la hermana, la madre y del testaferro y asesor informático, Diego Lagormasino era imposible que alguien pregunte de dónde venía el dinero. Después sí bien no apunta a tu pregunta, desde el gobierno saliente se utilizaron datos mezclados de la vida privada de Nisman que nada tenían que ver ni con la investigación AMIA ni con el propio misterio de su muerte. Esos datos fueron utlizados por un sector del gobierno para desprestigiar la figura de Nisman mezclados con datos que tienen que ver más con el manejo de los fondos, que sí creo que hay un interés público atento a que era una fiscalía y que él era un funcionario público.
– ¿Qué rol juega Stiuso en la muerte del fiscal?
– Yo creo que Stiuso es un personaje más importante que Nisman, por lo menos en la investigación de mi libro. Yo creo que el ex agente al que yo llamo el «Zar de la Inteligencia» sabe mucho más de lo que contó y de lo que la propia fiscal Fein, le pudo o se animó a preguntarle. Sobre todo teniendo en cuenta que hay algunas pericias telefónicas que lo acercan, indirectamente, aparecen llamados triangulados con personas vinculadas a Situso, justamente, personas que tenían como misión custodiar a Nisman, pero más que custodiarlo parecían estar controlándolo o haciendo las dos funciones al mismo tiempo. El fiscal mantenía infiltrada a su custodia. Nisman murió y hasta el último momento de su vida fue un blanco de inteligencia , la misma inteligencia de la cuál él se valía para conseguir informes e información que luego el le daba un valor jurídico. Ahí hay un juego medio macabro y perverso, que es el juego de la inteligencia.
– ¿Cree que en algún momento se va a saber la verdad?
– Más que querer es un deseo. Ojalá se sepa, pero a está altura llamo a la causa Nisman un laberinto sin salida por que creo que por más que mañana la justicia emita un dictamen va a haber una mitad de la sociedad que no va a creer lo que la justicia diga, sea cual fuere el fallo. Sí la justicia concluye que su muerte fue un suicidio ahí las personas que creen que lo mataron van a descreer de ella y van a avalar que la justicia está presionada por intereses y viceversa. Posiblemente, en algún momento, la justicia encuentre pruebas para pensar que Nisman fue acorralado y hostigado para pensar que fue llevado a tomar alguna decisión, bueno la situación en ese caso queda con menos dudas. Yo cuando murió Nisman lo primero que pensé fue en el atentado a la AMIA, porque es imposible despegar al ex fiscal del rol de investigador del atentado. Este año se van a cumplir 22 años y todavía hay tremendas dudas respecto de qué fue lo que pasó, cuál fue la participación de las fuerzas de seguridad locales, si existió o no un coche-bomba. Y si bien la justicia, Nisman y otras instancias judiciales, avalaron la teoría del coche-bomba hay un sector que no la cree aún hoy. Con lo cual estos temas siempre están diseñados desde el minuto cero para tener un alto grado de dudas.
– ¿Por qué decidiste escribir el libro llamado «Nisman»?
– El libro lo escribí con el desafío de tratar de esquivar esa suerte de pensamiento binario que había alrededor de esta causa, no voy a descubrir con este libro que la sociedad está políticamente dividida; lo estaba, lo está y lo estará un tiempo más. Lamentablemente en ese contexto electoral sanguinario sucede lo que sucede con el fiscal Nisman y rápidamente la causa queda adentro de esa dinámica de crimen o suicidio. Yo al ser abogado, quizás también con información jurídica tengo claro lo que en derecho penal llamamos la «materialidad de los hechos». Hay hechos concretos que no pueden estar sujetos a una especulación política de un lado y del otro. Lo que intente fue eso con el libro; agarrar el expediente y contrastarlo con mis propias fuentes, los datos que no me cerraban iba y los contrastaba. Desde ahí traté de hacer una reconstrucción de los últimos 9 días de la vida de Nisman y una reconstrucción judicial del fiscal, sin la lógica de la certeza del periodismo que levanta el dedo y te dice: «Yo te voy a contar la verdad», sino todo lo contrario. Es un libro que le ofrece al lector la posiblidad de que el lector vaya realizando una reconstrucción y que vaya generándose preguntas; y por qué hoy no estamos en condiciones de responder el enigma superior que es crimen o suicidio, pero sí posiblemente haya otras preguntas que uno pueda hacerse alrededor del hecho en sí y de la vida de Alberto Nisman. Posiblemente esas preguntas nos ayuden en algún momento, si la justicia nos entrega las respuestas, a poder responder el enigma superior que es si se mató o lo mataron.
