La Corte Suprema de Justicia comenzó esta mañana con la primera de las cuatro audiencias públicas en el caso iniciado por un grupo de madres de alumnos que pide la inconstitucionalidad de la ley que establece la religión obligatoria en las escuelas públicas de Salta.
Hoy se presentan varios de los amicus curiae que participan en la causa. Entre otros, ya hablaron Mariana Catanzaro y Guillermo Torremare, de la Asamblea Permanente por los Derechos Humanos (APDH); Jorge Gentile, profesor de Derecho Constitucional de la Universidad Nacional y de la Universidad Católica de Córdoba; Sebastián Friso, del Instituto Laico de Estudios Contemporáneos de Argentina; y Pedro Andereggen, del Partido Demócrata Cristiano.
Los representantes de la APDH afirmaron que las normas de Salta “van en contra de todo el ordenamiento jurídico argentino” y señalaron que es absurdo que se planifique separar a los niños, en referencia al argumento de las autoridades de que los chicos que no profesan la religión católica no son obligados a asistir a esas clases. “Se busca el pensamiento uniforme”, dijeron. En la misma línea que la APDH se manifestó Sfriso. “Todos sabemos honestamente que lo de Salta va en contramano a la historia. La escuela pública y laica es el mejor antídoto contra cualquier fanatismo”, remarcó.
En cambio, Gentile cuestionó que sin esa ley se priva a los chicos a conocer la historia religiosa de la Argentina y el mundo. “Más de la mitad de la escuelas de Salta tienen jornada extendida. ¿Qué quieren, que les den religión a las 12 de la noche?”, señaló sobre la necesidad de impartir esos contenidos durante el horario escolar. Andereggen también respaldó la posición del gobierno salteño al afirmar que los padres tienen derecho a elegir la educación de sus hijos y que “la educación religiosa en escuelas públicas es la única forma de hacer valer ese derecho”.
El proceso comenzó a raíz de un amparo colectivo iniciado contra el Ministerio de Educación salteño por varios padres junto a la Asociación por los Derechos Civiles (ADC) con el fin de que se eliminen las normas locales que establecen que la enseñanza religiosa integre el plan de estudios y se imparta dentro del horario escolar. La Corte de Justicia de Salta había confirmado la declaración de constitucionalidad de las normas, pero dispuso que se arbitrara un programa alternativo para quienes no deseen recibir formación católica durante el horario escolar y también estableció que los rezos sólo pueden tener lugar en las clases de religión. Sin embargo, las madres y la ADC recurrieron ante la Corte Suprema para que declare su inconstitucionalidad, alegando que su aplicación trae aparejadas “prácticas que lesionan los derechos constitucionales a la libertad de religión y de conciencia, a la igualdad, a la no discriminación y a la intimidad”.
Mañana será la segunda audiencia, y las siguientes se fijaron para el miércoles 30 y jueves 31, en la que participarán otras instituciones que se presentaron con la figura de “amigos del tribunal”.
