AMIA: Nisman pidió adelantar el juicio por encubrimiento contra Menem, Galeano y Palacios

En la causa se investiga el pago a Carlos Telleldín para que declare en contra de un grupo de policías bonaerenses que resultaron absueltos y la protección del empresario Alberto Kanoore Edul.

El fiscal general de la causa AMIA, Alberto Nisman, presentó hoy un escrito ante el Tribunal Oral en lo Criminal Federal N°2, en el que solicitó que se adelante para el primer semestre de 2015 el inicio del juicio oral contra los acusados de «alterar, obstruir e intentar neutralizar la investigación del atentado del 18 de julio de 1994». Estaba previsto que el debate comience recién en la segunda mitad del año.

En el escrito al que tuvo acceso Infobae, Nisman argumentó que «se encuentran cumplidas las condiciones procesales que permiten fijar una fecha próxima», habló de «trascendencia institucional» y subrayó la «relevancia y necesidad de adoptar una decisión definitiva».

En el expediente están imputados el ex presidente Carlos Menem y su hermano y entonces secretario Munir Menem, el jefe de la SIDE y su segundo, Hugo Anzorreguy y Carlos Anchezar, respectivamente; el ex comisario Jorge «Fino» Palacios, el destituido juez federal Juan José Galeano, los ex fiscales Federales Eamon Mullen y José Barbaccia, y el ex titular de la DAIA, Rubén Beraja. Nisman los acusa de encabezar una «compleja maniobra de encubrimiento, pergeñada desde los más altos estamentos políticos de la época, dirigida a entorpecer y abortar la investigación de uno de los hechos más graves que recuerde la historia reciente de nuestro país».

En concreto, se investigan dos hechos puntuales. Por un lado, el pago de 400 mil pesos dólares en dos cuotas a la esposa de Carlos Telleldín para que su marido declare que le vendió la Renault Trafic que se estrelló contra la AMIA a un grupo de policías bonaerenses encabezados por el comisarios Juan José Ribelli. También se habría presionado y sobornado a tres uniformados para dijeran que vieron la camioneta-bomba en la Brigada de Lanús, donde se desempeñaban los acusados.

Telleldín está imputado junto a su ex pareja, Ana María Boragni, y su abogado defensor, Víctor Stinfale. En una reciente entrevista con Infobae, admitió que le pagaron a través de la SIDE y que le prometieron su excarcelación, algo que finalmente no se materializó. «Si yo traigo 200 mil presos y les digo que si firman una declaración les dan 500 mil dólares y los largan en julio, firman lo que sea. Más si se lo dice el juez. Incluso por mucho menos firman que le sacaron las manos a Perón», se defendió el único procesado en la otra causa AMIA, la que investiga el ataque.

Ribelli y el resto de los policías fueron finalmente absueltos en 2003 y liberados. La «conexión local» resultó ser un fiasco para desviar la investigación.

El otro caso que se ventila en este expediente es el encubrimiento y protección del empresario textual Alberto Kanoore Edul, un nombre que se repite una y otra vez en la investigación, y sobre quien el FBI pidió profundizar las pesquisas.

Según el destituido Galeano, desde el teléfono de Edul hubo una llamada a la casa de Telleldín el mismo 10 de julio en que se publicó un aviso en el diario Clarín ofreciendo la camioneta. A su vez, el camión que dejó un volquete frente a la sede de la AMIA unos minutos antes del atentado hizo una parada luego en un terreno ubicado a metros de la casa de Edul, en el barrio porteño de San Cristóbal. El sospechoso también tenía en su agenda el nombre de Moshen Rabbani, agregado cultural de la embajada iraní en Argentina y considerado por Nisman como el «cerebro» del ataque.

El encubrimiento según Nisman fue político y policial. Por un lado, cree que lo protegió el Gobierno. Vale recordar: los Edul y los Menem comparten su origen en el pueblo sirio de Yabrud. Y en sede judicial el propio Edul reconoció que a los pocos días del ataque su padre, que a su vez aportó dinero a la campaña presidencial de Carlos Menem, visitó en la Casa Rosada a la secretaria deMunir Menem para pedirle información sobre la llamada «pista siria» que involucraba a su hijo.

Edul fue detenido por unos días, pero tras la gestiones de su padre, quedó en libertad. Munir Menem le habría pedido en persona a Galeano que «enfriara la pista siria». También por gestión del segundo de la SIDE, Juan Carlos Anchezar, el magistrado levantó la intervención telefónica sobre el empresario. Cuando seis años más tarde Edul fue puesto en el banquillo de los acusados, las grabaciones que se habían hecho durante un mes y medio se habían perdido.

En el encubrimiento policial uno de los imputados que está más complicado es el ex jefe de la Policía Metropolitana, Alfredo «Fino» Palacios, nombrado en 1997 al frente de la Unidad Antiterrorista, pero que participó en la investigación desde el primer momento. Se lo acusa de ser uno de los responsables de la pérdida de esos cassettes y sus transcripciones, así como de haber hecho todo lo posible para advertir a Edul de un allanamiento clave contra su vivienda dos semanas después del atentado.

De hecho, está probado que Palacios llamó desde su celular dos veces al domicilio de Edulantes del allanamiento e intentó ocultar esas comunicaciones. La policía llegó a la zona en la mañana del 1 de agosto, pero recién ingresó a la vivienda a las 17:30, después de alertar a todo el barrio. El ex comisario aseguró que telefoneó a la vivienda para constatar que estaba el sospechoso, pero para Nisman su objetivo fue alertarlo del operativo. De hecho, cuando ingresaron los uniformados, Edul había escapado.
