A 25 años del atentado a la AMIA, el Gobierno declarará a Hezbollah como organización terrorista

A través de un decreto, creará un registro para ampliar el marco de investigación de agrupaciones que hoy no pueden ser perseguidas por impedimentos legales

En una carrera contra reloj el Gobierno afina en estos días los detalles técnicos de un decreto presidencial que estaría destinado a crear un Registro Nacional de Personas y Organizaciones Sospechosas de Terrorismo (RENAPOST) con el doble propósito de dar una señal a la comunidad judía el 18 de julio cuando se cumplirán 25 años del atentado contra la AMIA y, al mismo tiempo, responder a un planteo que viene haciendo desde hace tiempo la administración norteamericana de Donald Trump en la región.

El esquema que se analiza en la Casa Rosada en estricta reserva persigue como intención de fondo consolidar una herramienta legal a fin de que la justicia y los organismos de seguridad en pleno puedan perseguir sin inconveniente alguno a las agrupaciones terroristas como Hezbollah o ISIS, ya que están no están encuadradas hoy en la arquitectura jurídica de la Argentina.

La administración de Mauricio Macri sólo se limitó en los últimos años a investigar agrupaciones terroristas encuadradas en la lista que ofrece Naciones Unidas y que no incluye a Hezbollah, uno de los grupos acusados judicialmente de participar en los atentados a la embajada de Israel en 1992 y en el ataque a la AMIA en 1994.

Sólo en contadas oportunidades el gobierno de Macri, por medio de la Unidad de Investigación Financiera (UIF), hizo uso de un decreto 918/2012 que viene de la época de Cristina Kirchner y que faculta al Poder Ejecutivo a llevar adelante el congelamiento administrativo de bienes y/o dinero vinculados a las acciones delictivas previstas en el artículo 306 del Código Penal con el fin de proteger la integridad del orden económico financiero, así como la paz y seguridad internacional, conforme a normas y estándares internacionales.

Así fue como el año pasado la UIF dictó el congelamiento de bienes y cuentas de los integrantes del grupo Barakat en la Triple Frontera, una organización criminal vinculada a Hezbollah.

Sin embargo, la intención del Gobierno es crear ahora por decreto el RENAPOST para ampliar el marco de investigación de agrupaciones que hoy no pueden ser perseguidas por impedimentos legales.

«La creación de un registro de personas y grupos sospechosos de terrorismo se sustentarán en resoluciones judiciales, pedido de otros países o el trabajo de inteligencia», dijo a Infobae un encumbrado funcionario del Gobierno que trabaja en la elaboración de este delicado mecanismo legal por decreto.

Esta idea se empezó a figurar en la mesa de acción contra el terrorismo que comparten el Ministerio de Seguridad, el Ministerio de Justicia, la Agencia Federal de Inteligencia (AFI), la Unidad de Investigación Financiera (UIF), la Cancillería, la Dirección de Migraciones, la Aduana y la AFIP.

Y según pudo reconstruir Infobae la orden impartida por Macri es que se intensifiquen las herramientas legales para la lucha contra el terrorismo y la cooperación internacional con intercambio de información sensible.

Otra de las fuentes consultadas por Infobae admitió que el Gobierno analiza la posibilidad de emitir un decreto en esta línea pero que no se sabe si se llegará al 18 de julio en que se cumplen 25 años del atentado a la AMIA.
«Incorporar en la Argentina un Registro de Personas y Organizaciones terroristas permitirá transparentar y sistematizar toda la información relacionada con investigaciones de terrorismo en el país», añadió otro funcionario de la Casa Rosada.

En la Secretaría Legal y Técnica de la Presidencia aun no llegó borrador alguno del tema. Es que antes deberá ser revisado por el secretario de Asuntos Internacionales Fulvio Pompeo y su equipo para que Macri posteriormente otorgue el visto bueno.

Desde el argumento legal del decreto se sostendrá que la creación de un Registro de organizaciones terroristas en Argentinas «permitirá disminuir las amenazas de potenciales ataques y disminuir los riesgos de un atentado».

Con la creación de este registro se ampliará la acción de persecución y encuadre de grupos terroristas ya que no sólo estarán comprendidos bajo el esquema de lavado de activos para su eventual detención.

Desde la AFI, el Ministerio de Seguridad, Justicia y la UIF, entre otros estamentos, creen que el decreto con la creación de un registro de operaciones terroristas generará que haya «canales más ágiles y rápidos para actuar ante movimientos de grupos terroristas».

Apoyo de AMIA y DAIA

Tanto la AMIA como la DAIA coinciden en la necesidad de que exista esta herramienta legal cuanto antes. De hecho, estas agrupaciones de la comunidad judía avalaron en su momento un proyecto de ley que había empezado a trabajar el diputado radical Luis Petri.

De hecho, este legislador de la UCR es uno de los impulsores más fervientes de este registro de personas y agrupaciones terroristas. Pero también sabe, al igual que buena parte del Gobierno, que los tiempos parlamentarios se acotan en medio de la campaña electoral y que la vía de un decreto presidencial sería una salida adecuada desde el punto de vista legal.

Desde la DAIA y la AMIA coincidieron en señalar a Infobae que la herramienta de un registro para incluir a Hezbollah en la lista de grupos terroristas en Argentina será «una muy buena señal» hacia aquellos familiares de las víctimas del atentado de 1994 que le costó la vida a 85 personas.

De hecho, la Alianza Internacional para el recuerdo del Holocausto (IHRA por sus siglas en ingles), a la que adhieren la DAIA y la AMIA, avala la necesidad de que todos los países sumen a Hezbollah en la lista de agrupaciones terroristas.

No hay coincidencias, en cambio, entre AMIA y DAIA en que una ley de juicio en ausencia pueda ser útil en términos prácticos para dar con los iraníes acusados del atentado de 1994. En este aspecto, la biblioteca está dividida ante el proyecto de ley de juicio en ausencia que también impulsa el Gobierno pero que no logró hasta ahora avanzar en el Congreso.

Geopolítica mundial

La presencia del secretario de Estado norteamericano Mike Pompeo el próximo 18 de julio en la Argentina será una visita con fuerte impronta para que la Argentina avance con los deseos de Washington de sumar a Hezbollah en la lista de agrupaciones terroristas.

Pompeo estará para el acto conmemorativo del atentado a la AMIA, se reunirá con Macri a solas y participará de la cumbre de cancilleres sobre terrorismo mundial en el Palacio San Martín.

En este contexto, la firma del decreto presidencial sobre la creación del RENAPOST será sin dudas una buena señal de la Argentina a Estados Unidos, un socio clave para Macri en el FMI donde acaba de renunciar temporalmente Christine Lagarde.

Para la cumbre de cancilleres de la región sobre terrorismo ya se está elaborando el borrador de un duro documento que firmará la Argentina con Estados Unidos y otros países para condenar al terrorismo en manos de agrupaciones como Hezbollah o países como Irán. Los planetas entre Macri y Trump vuelven a alinearse.

Entre el 9 y 10 de enero de este año la Office of Foreign Assets Control (OFAC), del Departamento del Tesoro de Estados Unidos, junto a la UIF realizaron un encuentro con sus pares de Paraguay y Brasil para profundizar la investigación que permita emitir alertas de operaciones sospechosas a bancos, casinos, casas de cambios y financieras alrededor del mundo para exhibir un entramado de «lavado de activos relacionados con el crimen organizado o el financiamiento del terrorismo».

Allí se mencionó la necesidad de avanzar en la región en una ampliación del listado de agrupaciones terroristas más allá de lo que ofrece la ONU y que la Argentina se limita a suscribir.

En países como Estados Unidos, Gran Bretaña, Israel, Canadá y algunos de la Unión Europea la agrupación Hezbollah está incluida en la lista de grupos terroristas y estos gobierno actúan en consecuencia ante la menor sospecha de miembros de esa organización criminal.

En el Consejo de Seguridad de Naciones Unidas Rusia ejerció en los últimos tiempos una fuerte presión para que la Asamblea de la ONU no contemple a esta agrupación terrorista con ramificación política en Líbano ya que se trata de aliados circunstanciales en Medio Oriente al igual que Irán.

En su visita a la Argentina el año pasado para la conmemoración de los 24 años del atentado a la AMIA el titular de la OEA Luis Almagro emitió un encendido discurso contra los grupos terroristas y destacó que «todos los Estados de este continente tienen la obligación jurídica y moral de actuar para no permitir estos atentados».

Almagro anunció que la OEA debe adoptar oficialmente la definición de antisemitismo de la IHRA y espera que «todos los estados miembros adopten esta definición también».

De esta manera, el titular de la OEA deslizó lo que en la reciente reunión de Medellín planteó en virtud de que todos los países de la región sumen a Hezbollah en sus listas negras de agrupaciones terroristas. Esto tiene un sentido concreto: una de las principales fuentes de dinero para Hezbollah son los grupos armados que operan en la región.

Hezbollah tiene sobrados vínculos con terroristas de las FARC y los miembros de los cárteles Los Zetas y Sinaloa, el primero, colombiano, y los dos últimos, de México. Uno de los hombres sirio-libaneses que también es sospechado de guardar conexiones con Hezbollah y el régimen iraní es el venezolano Tarek El-Aissami, actual gobernador chavista del estado de Aragua.

Y uno de los máximos referentes en materia de seguridad transnacional en la región, Carlos Benítez –director de la Secretaría para la Prevención del Terrorismo y la Investigación de Paraguay–, señaló que «hay sospechas de que elementos de Hezbollah con base en la Triple Frontera (su país, la Argentina y Brasil) están involucrados en el tráfico de drogas».

El embajador de Israel en la Argentina, Ilan Sztulman, acaba de expresar a Infobae antes de dejar su misión en el país una señal inequívoca: «Wl riesgo de un tercer atentado en la Argentina seguirá presente si no se incorpora al grupo Hezbollah en la ley como agrupación terrorista y si no se avanza con el juicio en ausencia para acusar a los iraníes involucrados en los ataques que hubo». No sólo ello: el embajador israelí cree que la Argentina también debería considerar a Irán como país que colabora con el terrorismo a nivel mundial.
