Un día como hoy se establece el primer estado judío en 2.000 años. El 14 de mayo de 1948, Israel declaró su independencia.

Antes de abril de 1948 no existía un proyecto de declaración de independencia. Un pequeño grupo de abogados y políticos dieron forma a la Declaración de Independencia de Israel, partiendo de la Declaración de Independencia de los Estados Unidos y la Constitución de los Estados Unidos como marco filosófico. Asimismo, otras decisiones políticas importantes concernientes al establecimiento del Estado judío se tuvieron que dejar para último minuto, entre ellas, la ubicación de la capital del Estado, su nombre definitivo y cómo unificar las diversas organizaciones militares bajo un solo comando. Las operaciones militares, en especial las relacionadas con Kfar Etzion, ubicado al sur de Jerusalén, desviaron la atención de la toma de decisiones finales en torno a estos temas. La solicitud de la Casa Blanca durante el Gobierno del presidente Truman de emitir una solicitud oficial por escrito para obtener el reconocimiento como Estado era otro asunto apremiante para David Ben Gurión, director de la Agencia Judía y futuro primer Primer Ministro de Israel.

El viernes 14 de mayo, tras algunas deliberaciones, el Consejo Nacional Judío, establecido para supervisar los asuntos políticos de la comunidad judía en Palestina, votó a favor de la aprobación del texto definitivo de la Declaración. A las 4:00 p. m. de esa tarde, el director del Consejo Nacional, David Ben Gurión, leyó la Declaración en el Museo de Tel Aviv. Debido a la falta de electricidad en Jerusalén, pocos en esa ciudad lograron escuchar las palabras de Ben Gurión o la interpretación y el canto del “Hatikva” (La esperanza), el himno nacional de Israel. Por razones de seguridad y ante la incertidumbre sobre una posible guerra con los Estados árabes, Ben Gurión pidió esa mañana a su secretario que contratara una caja de seguridad en un banco para guardar de inmediato la Declaración.

La Declaración hacía un compendio de la historia judía hasta 1948 y una declaración de intenciones de Israel para con sus habitantes, vecinos y la comunidad internacional. Se dividía en cuatro partes: 1) Una exposición de los fundamentos bíblicos, históricos y jurídicos internacionales de la existencia de un Estado judío en la Tierra de Israel; 2) el derecho manifiesto del pueblo judío de reclamar un Estado; 3) la declaración del establecimiento del Estado propiamente dicha; 4) declaraciones sobre el funcionamiento del Estado, entre ellas, una enumeración de los derechos ciudadanos. Se afirmó la necesidad de redactar una constitución, conforme con la resolución de la ONU que otorgaba legitimidad internacional a los Estados judío y árabe en Palestina. El objetivo de Israel de instituir una constitución se pospuso indefinidamente en junio de 1950.

Cabe destacar algunas similitudes y diferencias entre las (FotograPas de CZA) Declaraciones de Independencia de los Estados Unidos e Israel.
Ambas declaraciones afirman la independencia y el derecho de la población a determinar su propio destino, libre de las imposiciones legislativas y los abusos despóticos. En el caso de Israel, no obstante, se incluyó la historia reciente y se mencionaron las calamidades previas que padecieron los judíos, así como la perspectiva de un posible exterminio físico. Ambas declaraciones buscaron la autodeterminación y la libertad, sustentaron sus pretensiones en los derechos humanos y naturales, prometieron otorgar garantías de protección del individuo y proclamaron el interés en el crecimiento comercial y económico.

La Declaración de Independencia de Israel contenía una lista de reivindicaciones históricas relativas a la Tierra de Israel. La Declaración citaba hitos históricos en los que la comunidad internacional aprobó la legitimidad del Estado judío, en especial el reconocimiento otorgado por la Sociedad de las Naciones (1922) para la fundación de un hogar nacional, y por las Naciones Unidas (1947) para el establecimiento de un Estado judío. Si bien en 1776 cuando se firmó la Declaración de Independencia de los Estados Unidos había escaramuzas entre los estadounidenses y los británicos, cuando Israel declaró su independencia se hallaba en medio de una intensa guerra con la población árabe local los Estados árabes vecinos para lograr su supervivencia. A pesar de la guerra en curso, la Declaración de Independencia de Israel incluía un enunciado en el que ofrecía “paz y armonía” a sus vecinos y llamaba a “retomar la senda de la paz”. Ambas declaraciones hacen alusión a una autoridad superior. La Declaración de Independencia de Israel no menciona directamente la religión, sin embargo, cierra con la frase, “depositando la confianza en la Roca de Israel [Tzur Yisrael]” 1. La elección de esta frase era la solución verbal de Ben Gurión para lograr un equilibrio entre las fuertes presiones seculares y religiosas. Luego, al no haberse redactado una constitución, la frase “garantizará la libertad de religión, conciencia, idioma, educación y cultura” se convirtió en la base de las libertades civiles protegidas en Israel. Ocho horas después de la lectura de Ben Gurión de la Declaración, la Fuerza Aérea Egipcia arrojó sus primeras bombas en las afueras de Tel Aviv.
