En un país democrático como el nuestro, las decisiones de la justicia, en tanto poder independiente del Estado, deben ser siempre escrupulosamente respetadas.
Pero eso no impide que los ciudadanos manifestemos nuestras discrepancias, cuando entendemos que esas decisiones son equivocadas y aún más, minimizan graves problemas sociales, obrando involuntariamente en su persistencia.
Tal es el caso de la decisión del Tribunal de Apelaciones de la que informa el semanario Búsqueda en su edición de ayer, que reafirma la declaración de inimputable de Omar Peralta, el asesino del comerciante sanducero David Fremd.
Según la publicación, «por unanimidad el tribunal se pronunció a favor de mantener el fallo de primera instancia del juez Fabricio Cidade, que declaró a Peralta ‘autor inimputable de un delito de homicidio especialmente agravado’ y de un delito de ‘comisión y actos de odio, desprecio o violencia hacia determinadas personas’. Cidade le impuso ‘medidas de seguridad curativas’ en ‘régimen de internación en centro hospitalario psiquiátrico'».
Se divulgó además que dos estudios del Instituto Médico Forense determinaron que «los problemas psiquiátricos y los delirios de Peralta no le permitieron ser consciente del carácter ilícito de sus actos ni determinarse libremente”.
El trágico hecho ocurrió en 2016. Este criminal inimputable se desempeñaba como docente de educación primaria y solía manifestar públicamente su judeofobia. De las crónicas de esa época, recordamos los testimonios de vecinos sanduceros que lo veían participar en videojuegos violentos, en locales de maquinitas, y clamar a voz en cuello que había que matar a los judíos. Pericias realizadas en sus dispositivos personales permitieron detectar además que estaba en contacto con sitios web del islamismo terrorista.
No por casualidad, para asesinar cobardemente a David Fremd utilizó la misma metodología que por esos años era moneda corriente en Europa y Medio Oriente: una serie de puñaladas sucesivas en lugares clave que toma a la víctima por sorpresa. Era la conocida técnica de los «lobos solitarios» que trabajaban espontáneamente para el Estado Islámico y demás organizaciones terroristas, en aquella sombría época no tan lejana que retrotraía a la barbarie medieval, con católicos y judíos que eran decapitados, incluso frente a cámaras de video.
Aparentemente no valieron las explícitas declaraciones antisemitas del asesino, ni su modus operandi. El crimen de odio perpetrado no merece ser castigado con todo el peso de la ley, por el eximente de un trastorno psiquiátrico. ¿Acaso habrán estado menos perturbados los verdugos del Estado Islámico, que se ufanaban de sus ejecuciones masivas mostrándolas como espectáculos? El método reiterativo de estos atentados, ¿no es razón suficiente para encuadrarlos a todos en una categoría de máximo rigor penal?
El mensaje que debería dar el Estado es que criminales de estas características no son inimputables porque sus crímenes no pueden quedar impunes. De lo contrario se sienta un peligroso precedente: aprovechar cualquier eximente legal a favor del fanatismo criminal.
Este no es un asunto que afecte solo a la colectividad judía: es un problema grave de seguridad pública que debe ser encarado con más sensibilidad que tecnicismos. Con la misma lógica que asignamos el casillero de trastorno psiquiátrico a este criminal de odio, podríamos atenuar el castigo del asesino de los tres infantes de Marina del domingo pasado, por tratarse de un adicto a la pasta base, tal vez inconsciente de la barbaridad que perpetró. No puede ni debe ser así.
El mensaje que debería dar el Estado es que criminales de estas características no son inimputables porque sus crímenes no pueden quedar impunes. De lo contrario se sienta un peligroso precedente: el de aprovechar cualquier eximente legal para dar rienda suelta al fanatismo criminal y el exterminio de inocentes.
A cuatro años de acontecido, el crimen de David Fremd sigue interpelando a nuestra sociedad y nos hace preguntar hasta qué punto somos garantes de la seguridad de las minorías étnicas, culturales y religiosas. Hasta qué punto estamos avalando con decisiones livianas la continuidad de estos hechos luctuosos que destrozan familias.
No se trata de cobrar al grito: se trata en cambio de dar el justo valor a cada hecho de sangre, en un mundo convulsionado por la discriminación y la violencia contra quien tiene otro color de piel o profesa otro credo diferente al de la mayoría. Uruguay siempre fue una nación modélica en términos de integración social y el asesinato de Fremd cayó como un baldazo de agua fría en nuestra tradición republicana.
Llega la hora de defender esos valores, denunciando fuerte y claro el tratamiento trivial de tamaña injusticia.
