El Tribunal Superior de Justicia aprobó hoy la demolición de la casa del terrorista palestino que mató a Esther Horgen el 20 de diciembre.

El Tribunal Superior de Justicia aprobó hoy la demolición de la casa del terrorista palestino que mató a Esther Horgen el 20 de diciembre.

De esta manera, en una decisión dividida de 2 a 1, el Tribunal Superior votó a favor de demoler tanto el segundo como el tercer piso del edificio donde han vivido Mohammad Maroh Kabaha (asesino de Esther Horgen) y su familia, según lo solicitado por las FDI.

El juez Anat Baron discrepó de la decisión. Sostuvo que solo el tercer piso debe ser demolido ya que Kabaha vivía allí separado de su familia. La familia vivía en el segundo piso y desconocía sus planes asesinos.

Sin embargo, el juez Yitzhak Amit y el juez Daphna Barak-Erez dictaminaron que si una familia es consciente de la intención criminal de su familiar es solo un factor para decidir qué parte de un edificio demoler en relación con un asesinato nacionalista cometido como un acto de terror.

Dijeron que el Tribunal Superior en general no debería cuestionar la discreción de las FDI. En cuanto al mensaje de disuasión que se necesita en un caso dado para ayudar a prevenir el terrorismo en el futuro.

En contraste, los peticionarios en este caso y los críticos globales han dicho que Israel está aislado entre las democracias actuales. Ya que lleva a cabo demoliciones de casas en contra del derecho internacional.

Por su parte, Israel sostiene que existe una base para demolición de viviendas en el derecho internacional si el propósito es preventivo y no punitivo.
