Israel nombró como juez de la Corte Suprema a un musulmán

El Comité de Selección Judicial de Israel nombró a cuatro nuevos jueces de la Corte Suprema, entre ellos a un musulmán.

Los nombrados son: las juezas Ruth Ronen y Gila Kanfei-Steinitz, el juez Khaled Kabuv y el abogado del sector privado Yechiel Kasher.

Kanfei-Steinitz y Kasher son vistos como conservadores moderados, lo que asegura que Sa’ar puso su sello en el poder judicial y lo movió hacia la derecha nuevamente, dado que tres de los cuatro jueces reemplazados eran activistas moderados.

Ronen, por su parte, fue la elección principal de la presidenta de la Corte Suprema, Esther Hayut. Se espera que siga su enfoque activista moderado.

Kabuv pasó la mayor parte de su carrera manejando problemas de delitos económicos y tiene puntos de vista constitucionales menos conocidos. Además, será el primer juez árabe-israelí musulmán permanente en la Corte Suprema de Israel. Reemplaza al juez George Kara para ocupar el «asiento árabes-israelí». Los jueces árabe-israelíes anteriores siempre fueron árabes-israelíes cristianos.

Pese a los intentos de descarrilar su candidatura con respecto a las reuniones que mantuvo con activistas musulmanes cuestionables, Sa’ar logró impulsarlo.

Aunque, en general, la corte aún se inclina ligeramente por los activistas moderados 8-7, el marcador ahora está más cerca que nunca, con dos nuevos jueces que se unen a los conservadores: Noam Sohlberg, David Mintz, Yosef Elron, Alex Stein y los conservadores moderados Yael Wilner y Yitzhak Amit.

Dado que Hayut y la activista moderada Anat Baron se jubilarán en 2023, suponiendo que Sa’ar reemplace a uno de los dos con un conservador moderado, la corte cambiará a una mayoría conservadora moderada 8-7 por primera vez en décadas.

Los partidos mayoritarios de centro izquierda de la coalición parecen aprobar que Sa’ar mueva lentamente la corte hacia la derecha. El único impedimento es que se vinculen al ex primer ministro, Benjamin Netanyahu.

A principios de mes, Amnistía Internacional elaboró un informe en el que acusó a Israel de Apartheid. Específicamente dijo que mantuvo “un sistema de opresión y dominación” sobre los palestinos que se remonta al establecimiento del estado en 1948. Un sistema que, según el grupo, cumple con la definición internacional de apartheid.
