Un grupo de 57 pasajeros judíos presentó una demanda civil contra la aerolínea United por un incidente en pleno vuelo en 2023.
Durante un vuelo de United Airlines a Tel Aviv el 22 de abril de 2023, aproximadamente tres horas después del despegue, un pasajero se sentó en un asiento vacío de asistente de vuelo mientras esperaba para usar el baño, según la demanda presentada ante el Tribunal de Manhattan.
El asistente de vuelo informó el suceso al capitán como una “amenaza a la seguridad”.
La decisión del capitán fue regresar al Aeropuerto Internacional Newark Liberty.
Tras el aterrizaje, el personal de la aerolínea se negó a volver a embarcar a todos los “pasajeros visiblemente judíos”, alega la demanda, y no ofreció “ningún vuelo alternativo, alojamiento u opciones de viaje oportunas”.
Según la demanda, cuando un pasajero pidió explicaciones, un asistente de vuelo le dijo: “Ve y pregúntale a tu propia clase”.
Los demandantes, representados por Yoram Nachimovsky, acusaron haber sido sometidos a discriminación religiosa y étnica por parte de United Airlines durante el vuelo internacional, “lo que resultó en un castigo colectivo, trauma emocional e interrupción de sus planes de viaje”.

Además, la demanda añadió que United Airlines “actuó de forma deliberada, temeraria y con un desprecio temerario por los derechos de los demandantes, atacando a pasajeros visiblemente judíos como grupo, negándoles la continuación de su viaje y sometiéndolos a humillación y prejuicios basados únicamente en su religión y origen étnico”.
También afirma que no se examinó a la tripulación para detectar prejuicios y parcialidades.
Como el avión regresó “sin un motivo válido”, los pasajeros no pudieron asistir a las ceremonias del Día del Recuerdo y del Día de la Independencia en Israel de aquel año.
La demanda se presentó principalmente con base en la violación de la Ley de Derechos Humanos del Estado de Nueva York , relacionada con “discriminación ilegal contra los demandantes basada en la religión y la etnia”.
Otras causas de acción son la inflicción intencional de angustia emocional, la contratación y retención negligentes y los daños punitivos por mala conducta intencional.

Por su parte, United Airlines refutó las acusaciones y las calificó de “infundadas”.
En un comunicado, expresó: “Un pasajero, que representaba un riesgo para la seguridad, provocó el regreso del vuelo a Newark. Nuestra tripulación priorizó la seguridad y demostró profesionalismo al gestionar este asunto. Nos defenderemos enérgicamente contra estas falsas acusaciones”.
Esta no es la primera vez que la aerolínea es blanco de críticas por sus posibles acciones discriminatorias contra pasajeros judíos e israelíes.
Tras la masacre del 7 de octubre, United Airlines fue repudiada por permitir a su tripulación usar insignias con la bandera palestina.
