El fiscal de la causa, Carlos Stornelli, solicitó que se le dicte auto de procesamiento con prisión preventiva a Mariano Andrés Corera por haber intentado dar muerte a la joven Michelle Schmukler y a su hijo Tomer, de ocho meses de edad, por odio religioso, conductas con las cuales alentó e incitó al odio y a la discriminación contra los nombrados a causa de su religión. El denunciante es el Ministro de Justicia de la Nación, Doctor Mariano Cúneo Libarona.
Dichas circunstancias se verificaron el 4 de octubre del 2025, alrededor de las 13:30 horas, oportunidad en la que desde una de las ventanas del domicilio ubicadas en el tercer piso de su domicilio del barrio de Palermo, el imputado, le arrojó a Schmukler, quien se encontraba en el patio del departamento del primer piso del mismo edificio, junto a su hijo menor de edad, un elemento metálico contundente que no llegó a impactarlos, refiriendo expresiones tales como ‘judías, judías, judías, y ahora encima tenés un hijo judío que asco’.
Luego de ello, al acudir la pareja de la nombrada Idan Soifer, Corera le alegó
que ‘no había tenido puntería’.
Inicio de las actuaciones
Las presentes actuaciones se iniciaron el pasado 6 de octubre de 2025, a
partir de la denuncia efectuada por el Dr. Mariano Cúneo Libarona, Ministro de Justicia de
la Nación, ante la Excma. Cámara de Apelaciones en lo Criminal y Correccional Federal,
oportunidad en la que expuso hechos en perjuicio de Michelle Tamara Schmuker y Tomer
Calificación Legal
En función de lo expuesto, entiendo que la conducta que se le reprocha a
Mariano Andrés Corera, resulta constitutiva del delito de homicidio agravado por odio
religioso en grado tentado en concurso real con el delito de promoción de la
discriminación religiosa (art. 80, inciso 4° del Código Penal de la Nación, en función del
agravante del art. 2º de Ley 23.592 y del delito autónomo del art. 3º de la Ley 23.592).
Petitorio
En suma, en función de lo expuesto solicito al Señor Juez que se dicte
el procesamiento con prisión preventiva de Mariano Andrés Corera (arts. 306 y 312 del
Código Procesal Penal de la Nación) en orden a los hechos descriptos, los fundamentos
probatorios y la calificación legal formulados en el presente dictamen.
