Los abogados defensores de Cristina Fernández de Kirchner, Carlos Alberto Beraldi y Ary Rubén Llernovoy solicitaron la nulidad de la causa N° 14.305/2015/TO01 caratulada Fernández de Kirchner, Cristina y otros S/encubrimiento y traición. Además, piden que se fije una audiencia publicada televisada para exponer los motivos.
El objeto de la presentación es el siguiente:
«En los términos previstos por el 166 y siguientes del CPPN, venimos a promover el presente incidente de la nulidad. A efectos de solicitar que se declare la invalidez de los actos procesales que se indican a continuación:
La resolución dictada el 29 de diciembre de 2016 en el marco de la causa N° 777/2015 -luego acumulada a estas actuaciones – a través de la cual la Sala I de la Cámara Federal de Casación Penal dejó sin efecto la desestimación de la denuncia que dio origen al proceso. Apartó a todos los jueces que habían convalidado tal decisión y ordenó la remisión de la causa a un nuevo magistrado para su continuación.
Todo lo actuado en el marco del expediente N° 14.305/2015 (y su acumulada N° 383/2015) desde su inicio hasta el 30/05/2017. Fecha en la cual se dispusiera el trámite unificado de ambas causas (art. 172 del CPPN).

Todo lo actuado a partir del 30/05/2017 en el marco del proceso que quedara unificado bajo el N° 14.305/2015. Además, de manera particular, las declaraciones indagatorias recibidas a los imputados; el auto de procesamiento dictado en la primera instancia; su confirmación en las instancias superiores, los requerimientos de elevación a juicio formulados por todos los acusadores y el auto de elevación a juicio de la causa (art. 172 del CPPN).
Como consecuencia lógica del temperamento impetrado solicitamos que se deje sin efecto el auto de citación a juicio y se disponga el sobreseimiento de todas las personas que han sido injustamente imputadas en este proceso, con expresa mención de que la formación de esta causa en nada afecta su buen nombre.
También requerimos expresamente que tal mención alcance al Sr. Héctor Timerman, quien fuera sobreseído en este proceso por extinción de la acción penal.
A efectos de dar debido fundamento al presente planteo, en los capítulos siguientes habremos de desarrollar las circunstancias fácticas y jurídicas que lo sostienen y requeriremos que se practiquen una serie de medidas de prueba que permitirán objetivamente acreditar los graves episodios que serán.
Luego de que las partes constituidas en autos tomen la debida intervención en el incidente de nulidad promovido y evacúen las vistas respectivas, solicitamos que se fije una audiencia a fin de que todos los argumentos expuestos puedan ser debidamente oralizados, se reciba la prueba admitida y se permita alegar sobre su mérito.
Asimismo y dada la trascendencia que reviste el presente proceso, tal audiencia deberá ser llevada a cabo de manera pública. Autorizar a los medios de comunicación que así lo requieran a su transmisión en vivo».
