La defensa de Diego Lagomarsino pidió ante la Cámara de Casación que la causa por la muerte del fiscal vuelva a la justicia ordinaria, pero la querella que representa a la madre Nisman insistió con que el asesor informático “quiere su impunidad”.
El abogado querellante Pablo Lanusse (que representa a la madre de Nisman) reclamó que la apelación contra el pase a la justicia federal sea declarada “desierta” porque la defensa de Lagomarsino busca su “impunidad” y que “no se investigue su real participación en el asesinato de Nisman”.
Los abogados de Lagomarsino aseguraron que su defendido tiene derecho a ser juzgado en un “plazo razonable” y la causa lleva ya 15 meses de investigación por planteos dilatorios que formularon los propios querellantes. Además indicaron que desde que la causa pasó al fuero federal, a manos del juez Julián Ercolini, “no se hizo ninguna medida de prueba” y que solo se digitalizó la causa para buscar palabras y poder hacer una lectura más rápida.
El tribunal, integrado por los jueces Mario Magariños, Daniel Morín y María Laura Garrigós de Rébori, pasó a un cuarto intermedio antes de resolver qué juez seguirá con la causa, si Ercolini o la jueza de instrucción Fabiana Palmaghini.
