Tras un litigio de dos años, una jueza ha determinado que los hijos del redactor de la Declaración de Independencia de Israel sí pueden vender los borradores del histórico, documento que su padre poseía y que les heredó (en un precio que alcanza casi los 14 mil dólares), los que el Estado israelí reclamaba como suyos.
“Es la naturaleza de los eventos históricos dejar impresiones no solamente en documentos y objetos que le pertenezcan al Estado, sino también en documentos y objetos que sean propiedad de particulares” se lee en la decisión emitida por la Jueza del Tribunal de Distrito de Jerusalén, Tamar Bazak Rappoport.
Este fallo culmina un litigio iniciado en 2015, cuando los hijos de Mordejai Beham, un abogado de Jerusalén que redactó el documento en 1948 por mandado del primer Ministro de Justicia, Pinjas Rosen, pusieron a subasta en la casa Kedem los borradores del histórico documento que su padre les legó.
En cuando estos documentos se pusieron en subasta, representantes del Estado de Israel argumentaron que esto no podía llevarse a cabo ya que por la relevancia histórica de estos y por la naturaleza de Beham como trabajador del Estado, deberían pertenecer al Archivo del Estado de Israel y no estar en manos de particulares.
Los hijos de Beham argumentaron que su padre era un particular que se ofreció voluntariamente a ayudar a Rosen sin ser un empleado estatal, además de que habían pasado ya varias décadas desde la redacción.
Por el litigio que comenzó, la subasta se congeló por dos años, en los que ambas partes incluso trataron de mediar pero sin ningún resultado.
La sentencia de la Jueza fue favorable para los hijos de Beham remarcando que no todo el material de archivo le pertenece al Archivo del Estado de Israel, sino solamente el material que le pertenecía al Estado o a instituciones de gobierno que le precedieron.
El Estado puede examinar el material, fotografiarlo o copiarlo de manos de los dueños privados, pero en ningún caso puede nacionalizarlo.
Aunque la Jueza no logró determinar la naturaleza laboral de Mordejai Beham al momento de la redacción de los documentos, asentó que no todo documento que un empleado estatal redacta automáticamente le pertenece al Estado.
Dentro de la misma sentencia se condicionó la venta de los documentos a que estos no se le enajenarían a alguien que los sacara del país o que los diera a una entidad que no fuera una institución pública, museo o exhibición en Israel.
“El problema aquí no es lo de enajenar los documentos y arrojarlos a la basura de la historia, sino que que la litis es sobre la identidad de la entidad que controlará la exhibición de los documentos en público en Israel y si le permitirá el acceso de estos a los académicos”.
