«Se ha informado a la Secretaría General de Interpol que el 27/01/2013 se firmó un acuerdo entre la Argentina y la República Islámica sobre el atentado terrorista perpetrado en la AMIA en 1994 en relación con el presente informe para resolver esta cuestión en términos diplomáticos. El estado del presente informe sigue siendo el mismo que decidió la Asamblea General de Interpol en 2007. Cabe señalar que las autoridades argentinas informaron a la Secretaría General que los tribunales argentinos declararon inconstitucional el referido acuerdo en virtud de la legislación argentina. La Secretaría General no se pronuncia respecto del acuerdo y observa que su situación es una cuestión bilateral entre la Argentina y la República Islámica de Irán».
Esta es la traducción (no oficial) del texto que figura en la página reservada que ven los policías de Interpol debajo de las cinco alertas rojas de los responsables del crimen de 85 personas, según sospecha la justicia argentina. Infobaeaccedió al pedido de detención de Moshen Rezai, ex jefe de la Guardia Revolucionaria islámica, la sangrienta organización militar iraní, los verdaderos «guardianes» del régimen. Rezai es padre de Ahmad, quien declaró en los Estados Unidos que el ataque a la embajada israelí en Buenos Aires fue planeado en Teherán y contó que él mismo acompañó a su padre al Líbano, donde se entrenó a quienes perpetraron ese ataque.
Además de Rezai, el juez Rodolfo Canicoba Corral encontró responsables del atentado a la AMIA a Ali Fallahina, ex ministro de Inteligencia, Moshen Rabbani, ex agregado cultural de la embajada iraní en la Argentina y conocido de Luis D’Elía, Ahmad Vahidi, comandante de las fuerzas QUDS y Ahmad Ashgari, ex secretario de la embajada. El mismo texto figura debajo de esas cuatro alertas rojas también.
Esta inscripción es altamente relevante porque confirma que Irán logró que se defina al diferendo como un «asunto diplomático» luego de firmar el Pacto. El documento demuestra que a pesar de que el Memorándum no entró en vigencia, se cumplió en parte con el único objetivo que tenía Teherán, es decir, que se levantaran las circulares rojas. Además, se visualizó que había conversaciones diplomáticas entre ambos países para tal fin.
El Memorándum, dice el fallo del juez Claudio Bonadio, fue parte de la estrategia de la cancillería iraní para romper el aislamiento internacional y no un intento del gobierno de Cristina Kirchner de avanzar en la investigación del crimen. Para eso, ni siquiera se necesitaba la ratificación del acuerdo porque, como consta en el punto 7 del memorando, titulado «Interpol»:
– «Este acuerdo, luego de ser firmado, será remitido por ambos cancilleres al Secretario General de Interpol en cumplimiento a requisitos exigidos por Interpol con relación a este caso».
En la imagen también se especifica que la última ratificación fue realizada en agosto de 2017, una vez que Canicoba Corral declarara la vigencia de las alertas rojas. Para ocuparse del asunto, el gobierno argentino designó a Leandro Despouy como representante en la Comisión de Ficheros de Interpol, la oficina que sigue específicamente la evolución de las alertas rojas.
Es en este contexto que la Cancillería argentina recibió, tres meses después de esa actualización, la carta iraní que ratifica la vigencia de uno de los puntos más polémicos del Memorándum. En efecto, tal como lo explicó Javad Zarif a Jorge Faurie, para Irán se puso en vigencia «inmediatamente después de la firma del memorándum».
La pregunta que habrá que hacer, entonces, es: ¿sigue vigente el acuerdo, a pesar de que Argentina lo haya declarado inconstitucional? Y otra inquietud, que todavía no fue dilucidada: ¿qué recibió Argentina, o Cristina Kirchner o Héctor Timerman, a cambio de lo que logró Irán?
