La Comisión de Acusación del Consejo descartó someter al juez federal a juicio político, pero pidió que se le aplique una sanción económica equivalente a la mitad de su sueldo. Había sido denunciado por desestimar la denuncia de Alberto Nisman contra CFK.
Finalmente, Daniel Rafecas permanecerá en su puesto de juez federal y, si el plenario del Consejo de la Magistratura lo dispone, recibirá una sanción económica equivalente al 50 por ciento de su sueldo. Así quedó establecido en la Comisión de Acusación del Consejo de la Magistratura, donde esta tarde se aprobó el dictamen impulsado por Juan Bautista Mahiques, consejero del Poder Ejecutivo.
Hubo tres dictámenes en danza. El del Mahiques, al que se sumó el diputado oficialista Pablo Tonelli; el del senador radical Angel Rozas, que proponía la destitución; y el de Leónidas Moldes, quien sostuvo que no tenía sustento la acusación porque implicaba juzgar criterios de interpretación del magistrado.
Rafecas fue llevado al Consejo de la Magistratura por no haber haber abierto a prueba en dos ocasiones la denuncia del fallecido fiscal Alberto Nisman respecto del supuesto encubrimiento del atentado a la AMIA a través del memorando de entendimiento con Irán en el gobierno de Cristina Fernández de Kirchner. La sanción económica se fundamenta en que el juez llamó al hoy diputado macrista Waldo Wolff cuando el entonces dirigente de la comunidad judía apareció en televisión y criticó su decisión.
Esta tarde comenzó a tomar forma la postura del oficialismo con el dictamen que presentó Mahiques. Rozas no cejó en su intento de avanzar con la destitución y puso su dictamen sobre la mesa. Contó con el apoyo del diputado Mario Negri, correligionario y presidente del interbloque de Cambiemos en la Cámara baja. Solamente el senador chaqueño y el diputado cordobés votaron a favor de ese dictamen, que fue el primero que se trató. Luego se debatió el de Mahiques: antes de votar, Rozas pidió la palabra y adelantó que cambiaba su postura.
Por Twitter, Wolff aseguró que “volvería a denunciar” al juez. A primera hora de hoy había tuiteado: “Que cada uno se haga cargo de su voto”, y que “lo que haga hoy el Consejo de la Magistratura no cambia mi posición, ni la verdad”.
