El abogado Sergio Borisonik, ex secretario legal de la AMIA y ex secretario general de la DAIA, salió a hablar después de conocerse la noticia de que el Tribunal Oral Federal n°8 cerró la causa del Memorándum con Irán y liberó de toda imputación a los acusados, entre ellos, Cristina Fernández de Kirchner, Héctor Timerman y Carlos Zannini. Sergio Borisonik denunció que el juzgado violó la ley procesal y de jurisprudencia.
El también exfuncionario de la AMIA dialogó por Radio Rivadavia y dio sus opiniones sobre el manejo judicial de la causa. Allí, declaró que no hay posibilidad de establecer nulidades previo al debate de un juicio oral. Asimismo, Sergio Borisonik adelantó que intentarán reabrir el expediente. “No es correcto, no es un fallo que vaya a resistir, incluso porque va a ser apelado en la Sala de Casación”, explicó.
Luego, se le preguntó al exsecretario de la DAIA si el sobreseimiento tuvo un fundamento jurídico, o si fue solamente una decisión política para beneficiar a la expresidenta. “Para mí, claramente como letrado, la Justicia ha hecho un fallo político. Desde lo jurídico no tiene razón. Es claramente político, incluso por el momento político que vive la Argentina previo a las elecciones”, argumentó.
A su vez, habló sobre la existencia de pruebas y material que Alberto Nisman habría dejado para aportar a la imputación de los acusados. Aunque mencionó que nunca se pudo encontrar algo, sí comentó: “Jurídicamente, las pruebas que pudiesen acorralar o que pudiesen estar presentes o que tuviese Nisman tienen que ser corroboradas en un juicio de debate oral, que era el que, justamente, se iba a plantear”.
De este modo, tanto para el exfuncionario de la Delegación de Asociaciones Israelitas Argentinas como para varios sectores políticos, jurídicos y sociales, la intención del Tribunal de cerrar el expediente FUE a propósito. El fin del juicio oral era presentar las pruebas que podrían haber confirmado el encubrimiento para beneficio de Irán. Así, a Borisonik le pareció vergonzosa la supuesta postura política de la Justicia, informó El Intransigente.
