El 12 de marzo de 2019, los iraníes Sajjad Samiei Naserani y Mashoreh Sabzali vieron interrumpido su plan de cruzar el planeta con una historia inventada. Habían llegado al país como supuestos hermanos, con pasaportes israelíes falsos bajo los nombres de Netanel y Rivka Toledano. Presuntos ciudadanos de Israel que, efectivamente, no existían. Los números de esos documentos sí existían, correspondían a un hombre y una mujer cuyo pasaportes habían sido robados. De todas maneras, según el sistema internacional, figuraban como habilitados para viajar.
Finalmente, Naserani y Sabzali fueron encontrados en un hotel del Abasto, el cual pagaron con una tarjeta de débito con identidad falsa. Luego de que Interpol Israel confirmara sus datos a través de su filial local en la PFA. La causa estaba en manos del fiscal Jorge Di Lello y el juez federal Luis Rodríguez.
Cuando declaró ante Rodríguez, luego de que Interpol en Irán confirmara su identidad, Naserani dijo ser un fotógrafo nacido el 1° de noviembre de 1991 en la ciudad de Rasht. Es un pueblo que queda 240 kilómetros de Teherán.
Sabzali aseguraba ser una arquitecta graduada en la Universidad de Ferdowsi, en la ciudad de Masshad. Naserani justificó su huida de su país con una historia telenovelesca, aseguró que escapó por un supuesto adulterio. Dijo que se había enamorado de una mujer casada, afirmó además que los documentos utilizados los compró en España y que a la mujer detenida junto a él la conoció en ese país. También reconoció que habló con un abogado argentino, cuyo teléfono consiguió de internet, buscando regularizar su situación migratoria.

Así, fueron procesados y quedaron presos en el penal de Ezeiza, mientras muchos se preguntaban sobre su historia, si la pareja de fugados eran lo que decían ser, espías sin suerte o una avanzada del terrorismo islamista. En el medio, nunca fueron devueltos a Irán. Naserani y Sabzali quedaron aquí, presos.
Eventualmente, fueron a juicio oral por los delitos de uso de documento falso y asociación ilícita. Hoy por la mañana, tras un proceso de tres meses a través de videoaudiencias en el Tribunal Oral Federal N°6, la fiscal Gabriela Baigún pidió las penas de 7 años de cárcel para Naserani y 4 y medio para Sabzali, sobre quien consideró que no formaba parte de la asociación ilícita, según confirmaron fuentes judiciales.
Hoy por la mañana, el juez Néstor Costabel dio su veredicto: tres años de prisión en suspenso para ambos por el delito de uso de pasaporte falso, la misma pena y el mínimo que estipula la ley. Costabel disintió del criterio de Baigún, razonó que Naserani no conformaba asociación ilícita alguna a pesar de las pruebas en su contra. Ambos no irán a prisión, quedarán en libertad, en un país donde no tienen arraigo alguno, donde ingresaron bajo identidad falsa. Podrían salir de la misma manera.
La fiscal Baigún asegura: “Estoy absolutamente sorprendida. Tienen todas las condiciones que habilitarían que a estas personas no se les de la libertad. Voy a recurrir en Casación, obviamente”.
La historia detrás de Naserani y Sabzali, por lo pronto, tiene mucho más que viajar por el mundo con mentiras. Sus detenciones alzaron ciertas banderas rojas en el Estado argentino, sospechas de terrorismo. La instrucción del fiscal Jorge Di Lello no reveló nada al respecto.

La asociación ilícita por la cual Naserani fue imputado era un delito de otro color, una banda internacional compuesta por al menos seis personas, destinada a cometer delitos indeterminados como la falsificación de documentos públicos, el robo, el hurto, el encubrimiento y la falsedad ideológica, desde 2015 hasta 2019, en países como España, Portugal, la Argentina, el Reino Unido, Irán y Turquía.
Interpol en Teherán, capital de Irán, envió sus informes a la Justicia argentina: aseguró que Naserani y Sabzali habían salido hacia Turquía entre 2015 y 2016 con sus pasaportes legales. Sin embargo, no tenían antecedentes penales en su país.
No estaban solos en su esquema. Hay más, desconocidos todos. El requerimiento de elevación a juicio firmado por Di Lello en mayo de 2019, al que accedió Infobae, habla de una lista global de presuntos cómplices, de un hombre no identificado que usa un teléfono inglés bajo el alias de “Jalal Tyt Uk”, un secuaz apodado “Big Show” con un teléfono griego y un iraní que se hacía llamar “Jan Rambo”, “cuyo objetivo resultaba ser la facilitación del tráfico ilegal de personas, en diversos países -principalmente en la Unión Europea-, mediante la compra de pasajes aéreos con identidades apócrifas y la falsificación de los documentos necesarios para esos viajes, todo ello financiado, al menos, mediante el uso de una tarjeta de débito Visa obtenida a través de la apertura de una cuenta bancaria en Malasia, mediante un pasaporte de nacionalidad estonia apócrifo”.

El nombre en ese pasaporte es, irónicamente, el de Rivka Toledano, el falso alias israelí de Sabzali.
Para lograr sus presuntos fines, Naserani tenía un repertorio de material a su disposición. Los pasaportes que empleó con Sabzali para entrar al país eran tan solo una muestra. Había mucho más, pruebas que recolectó Baigún para la acusación y que demuestran la marca de un traficante de personas de clase global, o de un falsificador maestro.
Todo estaba dentro del celular Huawei de Naserani, con más de 2.300 contactos agendados. Se encontraron 96 capturas de detalles de pasaportes en blanco de diversos países, así como 65 fotos carnet de hombres, mujeres y niños.
Entre esas imágenes había, por ejemplo, un pasaporte español en blanco, formatos en blanco de pasaportes de Malta, o un pasaporte polaco con datos, pero sin foto.
La idea de la Justicia: Naserani hacía todo de cero. Una foto obtenida por Naserani terminaba en un supuesto pasaporte de Luxemburgo. Un análisis reveló líneas de edición de software en la imagen. Esa misma foto fue empleada luego en un documento de Portugal, o uno francés.

El teléfono Huawei, por otra parte, era la principal herramienta para comunicarse con el misterioso “Jan Rambo”, que a su vez se comunicaba con un hombre involucrado en una agencia de viajes basada en Atenas: a “Rambo”, el acusado le enviaba listas completas de nombres en formato Excel. “Se produce una ruta de información entre Naserani con distintos contactos a fin de obtener no solo la documentación falsa, sino también pasajes y tarjetas de embarques para distintos vuelos a nombre de los sujetos cuya documentación previamente proceden a falsificar”, asegura el expediente. Se encontró su tarifario: 7 pasaportes españoles, poco menos de mil euros.
Hay algo más alarmante todavía: los mensajes siguieron entrando. tras su captura. Por cuatro días, un contacto le envió imágenes de pasaportes argentinos. Algunos denunciados tiempo antes como perdidos o robados en zonas como Barcelona. Otros directamente falsos, con fotos o nombres que no correspondían, o con números que no son propios del RENAPER.
Tres titulares de esos documentos incluso declararon en el juicio. Pudieron relatar, con detalles, cómo les robaron los pasaportes que terminaron en el celular de un supuesto traficante global. Uno de estos teléfonos, según fuentes de la causa, le será devuelto a Naserani tras recibir la pena en suspenso.
