En enero de este año la justicia reactivó la investigación sobre los movimientos de dinero del fallecido fiscal Alberto Nisman y de su familia. En el marco del expediente por presunto lavado de dinero, el juez federal Marcelo Martínez De Giorgi había ordenado embargar las cuentas bancarias de Sara Garfunkel, Sandra Nisman -madre y hermana del ex fiscal, respectivamente-, y de Diego Lagomarsino. Esté último procesado como coautor del homicidio del ex titular de la UFI AMIA. Pero la Sala I de la Cámara Federal revocó las medidas cautelares y ordenó realizar un nuevo cálculo.
Hace seis años, la justicia comenzó a investigar los bienes del grupo familiar del ex fiscal, de Diego Lagomarsino y de Claudio Picón. Fue luego que hallaron el cuerpo de Nisman en su departamento.
Entonces, se requirieron detalles de declaraciones juradas y todo lo vinculado a la conformación patrimonial. Las medidas se impulsaron en el marco de una investigación por presunto lavado de dinero.
El juez Martínez De Giorgi ordenó en enero una serie de medida patrimoniales sobre la madre y la hermana de Nisman. Lo hizo con el fin de “evitar que los imputados pudieran continuar obteniendo un beneficio de lo que podría ser producto de un ilícito”. Según el informe al que accedió Clarín

El magistrado señaló que el paquete de medidas de prueba ordenadas -entre ellas el embargo y congelamiento de cuentas bancarias- tenía como finalidad “establecer una evolución económica histórica de los ingresos y egresos de Sara Garfunkel y Sandra Ruth Nisman, los señores Diego Ángel Lagomarsino y Claudio Picón, como también el señor Alberto Natalio Nisman”.
Por ello, se le encomendó a la Dirección de Asistencia Judicial en Delitos Complejos y Crimen Organizado que efectúe a través del Cuerpo de Peritos del Poder Judicial especializado en casos de corrupción y delitos contra la administración Pública, un estudio sobre ellos.
En esta pericia contable se recomendó tener en cuenta “la información que surge de las bases de ANSES. AFIP. BCRA. NOSIS. FIDELITAS. Además de VERAZ, y cualquier otra que pueda resultar una fuente accesible de datos, a cuyo fin deberán ser consultadas”.
Acompañando estas medidas, y con el objetivo de conocer en detalle los bienes declarados por Alberto Nisman, el juez requirió al Juzgado Nacional Civil 99 la lista del acervo hereditario en el marco de la sucesión del fiscal.
Al analizar esas medidas, la Sala I de la Cámara Federal porteña sostuvo ahora que «la traba de un embargo preventivo sobre la totalidad del patrimonio de los encartados luce desmesurada«.

Entonces, los jueces Leopoldo Bruglia, Pablo Bertuzzi y Mariano Llorens revocaron los embargos sobre el patrimonio de la madre y de la hermana de Alberto Nisman. También las medidas dictadas sobre las cuentas bancarias.
Los camaristas indicaron que las medidas cautelares «que atañen específicamente a los bienes que hubieran sido instrumento o producto del delito, no permiten avanzar sobre el patrimonio de los imputados si no existe una vinculación lógica entre los bienes afectados y la hipótesis de lavado de activos formulada en la pesquisa», sostiene la resolución a la que accedió Clarín.
Bajo la misma línea de investigación, el juez Martínez De Giorgi había ordenado la intervención de un conjunto de empresas. Ellas son: “Palermopack S.A.” Starpack S.A.” y “Easy Pack”, y la designación de un interventor veedor informante por el plazo de doce meses. Todas vinculadas a Claudio Picón.

En su oportunidad, se había señalado que había sumas elevadas de dinero que se desprendieron de documentación personal e información recogida de la computadora de Alberto Nisman, que no lograban justificarse.
Las pruebas se incorporaron al expediente por lavado de dinero. Allí, se determinó que había un fideicomiso de unos 60 mil pesos. Además de gastos de tarjeta de crédito por unos 40 mil y expensas en dólares por lotes exclusivos en Punta del Este.
Por tal motivo, los jueces de la Sala I plantearon que este expediente, «se circunscribe en principio a: los fondos depositados en la cuenta del Banco Merrill Lynch (unos 600.000 dólares). El dinero ingresado al “Fideicomiso Dorrego» (de departamentos), determinados bienes registrables (un automóvil marca Audi y terrenos en Uruguay) y ciertas empresas (en virtud de depósitos detectados y de que una de ellas figura como titular del vehículo que fue señalado)».

Por tal motivo, entendieron que las normas utilizadas para ordenar los embargos preventivo «no permiten sustentar el embargo dispuesto sobre el patrimonio de los encausados en su totalidad (bienes inmuebles, muebles registrables y cuentas bancarias), tal como ha sido ordenado por el magistrado instructor», concluyó la Cámara.
En esta línea ordenaron recalcular el monto del embargo y que se aplique una «suma concreta». En relación a la imputación que recae sobre la familia de Nisman.
La causa por lavado de dinero estaba en el juzgado a cargo de Rodolfo Canicoba Corral, pero desde su jubilación es Martínez De Giorgi quien subroga el cargo.
El técnico informático y los familiares de Nisman figuran como cotitulares de una cuenta bancaria en el banco Merril Lynch de Nueva York. Según indicó la imputación judicial habría omitido su condición de funcionario del fallecido fiscal. Él como apoderado de esa cuenta se inscribió como lawyer on practice (abogado en ejercicio). Fue ese el puntapié de la investigación a la que luego se le sumaron otros bienes bajo la mira. Otra cuenta bancaria en el Uruguay, tres lotes exclusivos en Punta del Este y un fideicomiso en Capital Federal.
